Abstract

Constitutional Court Decision Number 82/PUU-XXI/2023 is an issue that has attracted the author's attention, several things have not been properly considered by the Constitutional Court (MK) when considering the plaintiff's petition. The request which was one of the reasons why public participation did not take place was related to the public consultation on the 2023 APBN Bill, only the internal Ministry of Finance was involved in it. This research aims to analyze Constitutional Court Decision No. 82/PUU-XXI/2023 to ensure implementation and community participation in the development of legal regulations. The type of research used is normative legal research and the application of a statutory approach, concept approach, analytical approach, and case approach. The results of research on the use of aspects of community participation or the principle of openness have not yet been implemented by legislators (regelging) from the first stage to the end of the bill. This can be seen from the existence of open gaps, discrimination, as well as the occurrence of a massive, systematic, and organized conflict of interest which also occurred in the PPP Bill, the Health Bill, the Assessment Bill (appraisal) of the APBN Bill and RDPU as well as public consultations on the drafting of the APBN Law by Ministry of Finance.

Rahmad Hidayah, Magister of Law Study Program, Faculty of Law, Social and Political Science, Mataram University

Rahmad Hidayah was born in Bima in 2000. Starting his college in 2017, he took law studies at University of Mataram, while his study process, he joined the internal student organization (BEM) of Al-Azhar Islamic University, after he finished his BEM membership, he was appointed as Treasurer at the student representative council (DPM) of Al-Azhar Islamic University 1 for the 2019-2020 period, he has completed his Bacheleor of Laws degree in 2021, Concentration in Constitutional Law at Al-Azhar Islamic University Mataram (NTB). Now on the way to seeking knowledge, he is completing a Postgraduate undergraduate education program, concentration in Constitutional Law at the University of Mataram. Prof. Dr. H. M. Galang Asmara, Magister of Law Study Program, Faculty of Law, Social and Political Science, Mataram University

Galang Asmara born in Kawo Central Lombok, he received his bachelor of law from faculty of law at University of Mataram in 1981. He obtained his Master of Law Studies degree at University of Padjajaran in 1997. His doctoral program is achieved from University of Airlangga in 2003. He is actively teaching bachelor till doctoral degree students in law faculty of Mataram University such as Legal Reasoning, Professional Ethics and Responsibility, Legal Theories, etc. He is the chief of Associaton of Constitutional and Administrative Law Lecturers of Indonesia (APHTN-HAN) in west nusa tenggara region. Dr. Chrisdianto Eko Purnomo, SH., MH., Magister of Law Study Program, Faculty of Law, Social and Political Science, Mataram University

Chrisdianto Eko Purnomo was born in Mataram in 1978, completed his Bachelor of Laws degree at the University of Mataram in 2003, then his Master of Laws degree achieved at University of Padjajaran in 2008. He completed his doctoral program at Padjajaran University in 2014. He has taught at various universities and is now active as a permanent lecturer at the Faculty of Law at the University of Mataram, in the field of Constitutional Law.
