Abstract

This research aims to analyze the position of Supreme Court Regulation No. 02 of 2012 in determining minor offenses in the criminal law enforcement process and to analyze the binding force of Supreme Court Regulation No. 02 of 2012 in law enforcement practice. The research method used is normative legal research with statutory and conceptual approaches. The research results show: 1) Supreme Court Regulation No. 2 of 2012 concerning the Adjustment of the Limitation of Minor Offences and the Amount of Fines in the Criminal Code is not included in the hierarchy of Laws and Regulations, but the Supreme Court Regulation is recognized as long as it is ordered by higher Laws and Regulations or formed based on authority, so the position of this Supreme Court Regulation is not equal or below the Law; 2) The Supreme Court Regulation is binding on the Police, Attorney General's Office, and Courts due to the signing of a Joint Memorandum of Agreement with the Minister of Law and Human Rights of the Republic of Indonesia, the Attorney General of the Republic of Indonesia and the National Police of the Republic of Indonesia.

M. Hijratul Azmi, was born in Mataram on June 11, 1994. In 2012 she completed her high school at SMA Negeri 5 Mataram, in Mataram City, West Nusa Tenggara, Indonesia. In 2021, she received her Bachelor of Laws degree from the Faculty of Law, University of Mataram. He is currently undergoing studies as a Master of Law student at the University of Mataram. Amiruddin, Master of Law Studies Program, Faculty of Law, Social Sciences and Legal Studies, University of Mataram, Indonesia

Amiruddin, born in Bima, West Nusa Tenggara. He completed his undergraduate program at the Faculty of Law at the University of Mataram in 1983. In 1985 he was appointed as a permanent lecturer at the Faculty of Law, University of Mataram. S2 and S3 programs from Airlangga University and completed in 1996 and 2010. In addition to teaching in the undergraduate program, he also teaches in the Master of Law program at the University of Mataram. He actively conducts various research programs and has produced several scientific papers that have been published nationally. The author can be contacted via email: amiruddin@unram.ac.id.

Rina Khairani Pancaningrum, Master of Law Studies Program, Faculty of Law, Social Sciences and Legal Studies, University of Mataram, Indonesia

Rina Khairani Pancaningrum, she obtained her Bachelor of Law degree from Mataram University in 2004. She obtained her Master of Law degree at GadjahMada University in 2008. Then she obtained her Doctoral Program from GadjahMada University in 2019. She actively teaches undergraduate to doctoral students in the field of law at the faculty of the University of Mataram. She teaches courses in Economic Criminal Law, Ethics and Professional Responsibility, Criminology and Victimology, Introduction to Legal Philosophy, Corruption Crime, Procedural Law of the Constitutional Court, Criminal Law Outside the Criminal Code, Civil Court Practice, Religious Court Procedure, Legal Anthropology, Religious Court Procedure, Sociology, and many more courses that she teaches.
